Thank you for your follow up email that omits the central fact that both camera's are defective and not working and we have on several occasions (in line with UK consumer acts rights ) any retailer delivering defective product must recover them at their own
 cost.

I still have them here at our house (the delivery address) and you can pick them up any time.

Please read the email string below with "Lin" where you offer miserly discounts of 3% if we keep defective non working cameras and try to charge us half the cost (return costs and handling charge) to return defective products which is against UK law.

I have been a retail CFO several times and am minded to issue legal proceedings for harassment and flagrant breaches of UK consumer law.

You have two options,

1 Apologies and move on and collect your own defective products which have been here at all times for your collection.

2 I take you to the small claims court and issue a charge against your company.

Don't bother coming back with polite messages from a "scam" company and your emails below incriminate your legal position.

Hi Dispute Team,

I am somewhat surprised to hear from you as I believe the merchants query of our dispute is out of consumer act response time and his goods have been at my house for collection and still are and he has shown no interest of communication in coming to pick up
 his defective goods.

Before I answer your queries directly a few facts can be given.

My wife and I are both experienced drivers and have used several brands of radar detectors before and know how to install them (very simply plug them in) and how to use them and how they work. My wife Mihaela Kowalska ordered the goods which is why the emails
 are from her.

These Chinese made products plug in and light up and then never change status whether there's a car speed detector radar or not and we tried to get it working for three days to no avail.

This is simply a scam by this so called merchant. When we contacted him to say they are defective he first offered us a 3% discount if we get them when we said no he moved to 10% ?? Why would we take a discount on a product that doesn't work.

We paid £19 for express delivery and they came a week later than promised and he blamed the shipping company- not our problem.

He then informed us that we could get a refund less his handling fee! if we returned them at our own expense to Hong Kong which is illegal to ask for a consumer to pay for the return of a defective product. You will note he stresses in his email replies below
 that its not the same as the delivery address and in fact he never ever gave us a return address simply we had to pay the £35 to return defective products plus a handling fee is a joke.. Again not a transparent way of operating.

We instead said he can come to our home /delivered address and pick them up himself - obviously nothing from him.

He is a cowboy trader relying on people not bothering to do a chargeback and making money out of defective products no doubt bought for very little and actually needs to be taken to court.

I have also been a Finance Director in the retail sector for over 25 years and know a rogue trader when I come across one.

In answer to your queries;

1/2 Photo attached of defective radar detectors still at our house- I suggest you ask him to pick them up rather than credit them back.

3 No dispossession of goods

4 Merchant comments- See above he does not address the fact that they were defective only as described but they didn't work as our email exchange below

Hello,

Having checked the UK consumer rights legislation (which I suggest you do as well) it is illegal to charge a consumer return costs when the product is faulty.

Secondly you can come and pick up your faulty product from our home address at your own cost even though I offered to return it for you.

Lastly there will be a full chargeback within two weeks.
